1. Acceptance of Terms

By accessing the Ultra-Go website (the "Site"), joining our waitlist, or downloading and using the Ultra-Go mobile application (the "App"), you agree to be bound by these Terms of Use ("Terms") and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this Site and the App.

2. Health & Nutrition Disclaimer

IMPORTANT: Ultra-Go is NOT a medical tool and does NOT provide medical advice.

Ultra-Go is a race strategy, pacing simulation, and nutrition planning tool. The suggestions, estimates, and calculations provided by the App (including, but not limited to, target carbohydrates, fluid intake, sodium targets, and estimated segment split times) are based on generic physiological models, scientific baselines, and data inputs supplied directly by you.

These calculations and suggestions:

  • Do not constitute medical, health, clinical, or professional coaching advice.
  • Should not be used to diagnose, treat, cure, or prevent any medical condition.
  • Do not replace the expertise and individual guidance of qualified healthcare professionals, certified dietitians, or coaches.

Running ultramarathons, trail races, and carrying out physical exertion at high intensity carries inherent risks of injury, illness, dehydration, hyponatremia, heat stroke, and other life-threatening medical emergencies. You are solely responsible for verifying that your nutrition plan, target intakes, and pacing goals are safe and suitable for your individual health circumstances. Always consult a qualified healthcare professional before beginning any new training program or nutrition protocol.

By using the App, you acknowledge and agree that your participation in athletic training and racing is entirely at your own risk, and that Ultra-Go accepts no liability for any adverse health outcomes or injuries resulting from the use of the App's formulas or timelines.

3. Local Data Storage & Backups

Currently, the Ultra-Go mobile application processes and stores your user profile details (including name, age, height, weight, sex, sweat rate category, and gut training level), custom pantry items, and race strategies locally on your device (using AsyncStorage).

Please note that:

  • We do not host, synchronize, or back up this data on centralized cloud servers.
  • If you delete the App, format your device, clear App storage, or if your device is lost, damaged, or stolen, your data will be permanently lost.
  • It is your sole responsibility to maintain external backups of your race planning parameters and GPX files.
  • Ultra-Go is not liable for any data loss or corruption occurring on your device.

4. Waitlist Sign-up & Communications

When you register for the Ultra-Go waitlist on our Site, you provide your email address. By signing up, you agree to receive communications regarding early access invitations, beta testing opportunities, feature releases, product updates, and promotional content. You can opt out of these emails at any time by clicking the unsubscribe link provided at the bottom of our emails.

5. Future Paid/Pro Subscriptions & Cloud Features

While the initial versions of Ultra-Go focus on local device storage, we reserve the right to introduce cloud-based syncing, multi-device backup features, premium features, and a paid Pro subscription tier in the future. The terms, pricing, and refund policies for such premium features will be governed by additional terms presented to you at the time of purchase or transition.

6. Intellectual Property

All content, designs, logos, graphics, source code, pacing algorithms, and proprietary formulas utilized on the Site and in the App are the exclusive intellectual property of Ultra-Go and its creators, and are protected by applicable copyright, trademark, and other intellectual property laws.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Ultra-Go, its developers, or its affiliates be liable for any damages (including, without limitation, damages for loss of data, personal injury, adverse health events, loss of profits, or business interruption) arising out of the use or inability to use the materials on the Site or the App, even if we have been notified orally or in writing of the possibility of such damage.

8. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Belgium, European Union, without regard to its conflict of law provisions. Any dispute, claim, or controversy arising out of or in connection with these Terms or the breach, termination, enforcement, interpretation, or validity thereof, shall be subject to the exclusive jurisdiction of the competent courts of Belgium.
